Fallon County District Court had two related cases with a change of plea hearing Tuesday. Leroy Cunningham pleaded guilty to 6 of the 8 charges against him. A count of Operation of Unlawful Clandestine Laboratory was dismissed. Cunningham also pled no contest to a charge of Criminal Child Endangerment. According to a non-binding plea agreement Cunningham would serve a 10 year sentence in the Montana State Prison with 5 years suspended and also pay associated fines and surcharges as ordered by the court. Sentencing is set for January 23, 2018 at 1:30 pm. Kayla Kloetzke also changed her plea to guilty on a charge of Criminal Possession of Dangerous Drugs. She pleaded no contest to two other charges and had 4 others dismissed. In a non-binding plea agreement Kloetzke would face 6 months suspended in the county jail and a 500 dollar fine on count 2 Endangering Welfare of Children, and on Count 3 and 4 Criminal Possession of Dangerous Drugs would serve 4 years in the Montana Department of Corrections and a 1,000 dollar fine on both to run concurrently. Sentencing has been set for January 23, 2018 at 3:30 pm. Both Cunningham and Kloetzke are out on bond and must abide by the restrictions placed on them by the court.
